Experience On Your Side
David R. Lipson was educated at Harvard Law School and Stanford University. He then served as a law clerk for a Justice of the Supreme Court of California and for a federal district judge. Since beginning his legal career thirty-eight years ago, he has had experience as an attorney both in private practice and in the public sector, and as Associate General Counsel for a Fortune 500 corporation.
David Lipson is decisive in litigation, but he also has a substantial background in alternative dispute resolution (ADR) techniques, such as mediation. He has litigated significant cases in the areas of employment discrimination, wrongful discharge from employment, insurance bad faith, contracts, antitrust, and personal injury. He has represented both plaintiffs and defendants, which enables him to anticipate the other side’s perspective. He has negotiated and drafted a wide variety of contracts (for example, executive employment agreements, purchase and sale contracts, commercial real estate leases, and agency and consulting agreements). In each of these contexts, David Lipson has an unusual ability to represent diverse clients with different types of legal problems. Representative clients have included Napa Valley wineries, a San Francisco auto dealership, software companies, investment advisers, and individual clients alleging wrongful discharge and employment discrimination on the basis of race, sex, and disability.

A Reasonable Approach to Legal Fees
Our approach to legal fees is different from that of many law firms. We handle plaintiffs’ cases on a contingent-fee basis when successful litigation appears probable. We also represent plaintiffs on a “blended” rate basis — a combination of a reduced contingency percentage and a reduced hourly rate.
When David Lipson represents defendants in litigation or does contract or transactional work, he bills on an hourly basis but excludes time that does not provide value directly to a client. For example, if a case, or a contract, suggests several legal theories or issues, but research on only one or two proves to be relevant, we bill only for the relevant time.
